Zamider Pay Terms of Service (Last updated: January 12, 2026)

Welcome to Zamider Pay (payment.zamider.com). These Terms of Service (“Terms”) govern your access to and use of the Zamider Pay website, mobile application, API, payment gateway services, and any related features (collectively, the “Services”) provided by Zamider Pay (referred to as “we”, “us”, or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

  • You must be at least 18 years old and legally capable of entering into contracts to use our Services.
  • By using Zamider Pay, you represent and warrant that you meet these requirements.
  • Business accounts must be registered by an authorized representative of a legally operating business in Bangladesh or any permitted jurisdiction.

2. Account Registration & Security

  • To use our payment gateway and other features, you must create an account and provide accurate, current, and complete information.
  • You are solely responsible for maintaining the confidentiality of your account credentials (email, password, API keys, etc.) and for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized use or security breach.
  • We reserve the right to suspend or terminate accounts for any violation of these Terms.

3. Description of Services

Zamider Pay provides the following services:

  • Online payment gateway integration for websites, mobile apps, and e-commerce platforms
  • Support for multiple payment methods including bKash, Nagad, Rocket, Credit/Debit Cards, Bank Transfer, and Digital Wallets
  • Recurring billing and subscription management
  • Real-time transaction tracking, reporting, and analytics
  • Easy API integration and ready-made plugins (WordPress, WooCommerce, Shopify, Laravel, etc.)

We act solely as a payment facilitator and do not own, control, or assume responsibility for the products, services, or content sold or provided by merchants.

4. Fees, Pricing & Payment

  • Transaction fees, setup fees, monthly fees (if any), and other charges are displayed in your merchant dashboard or during registration.
  • All fees are non-refundable unless expressly stated otherwise.
  • We may change fees or introduce new charges with at least 30 days’ prior notice via email or dashboard notification.
  • You are responsible for all taxes, duties, and other governmental charges related to your use of the Services.

5. Prohibited Activities

You agree not to use the Services for any of the following:

  • Illegal activities, fraud, money laundering, or prohibited products/services (e.g., gambling, adult content, weapons, counterfeit goods without prior written approval)
  • Violation of any applicable laws, including Bangladesh Bank regulations and PCI DSS standards
  • Attempting to reverse-engineer, hack, interfere with, or disrupt the Services
  • Providing false, misleading, or inaccurate information
  • Processing payments for high-risk businesses without our prior written approval

Violation may result in immediate account suspension, termination, and reporting to relevant authorities.

6. Merchant Responsibilities & Obligations

  • You must comply with all applicable laws and regulations in Bangladesh and your customers’ jurisdictions.
  • You are solely responsible for customer disputes, refunds, chargebacks, product/service delivery, and customer support.
  • You must not store sensitive cardholder data on your servers (use our tokenization system instead).
  • You must provide accurate receipts/invoices and comply with consumer protection laws.
  • You agree to indemnify Zamider Pay against any claims arising from your products/services or breach of these Terms.

7. Refunds, Chargebacks & Disputes

  • All refunds must be processed through your Zamider Pay dashboard.
  • You are fully liable for all chargebacks, disputes, reversal fees, and related costs.
  • We may place holds, reserves, or set-offs on your funds in case of high chargeback rates, suspected fraud, or legal requirements.
  • We reserve the right to recover any losses from your account balance or future settlements.

8. Intellectual Property

  • All content, logos, trademarks, software, technology, and materials used in the Services are owned by Zamider Pay or our licensors.
  • You are granted a limited, non-exclusive, non-transferable license to use the Services solely for your business purposes.
  • You may not copy, modify, distribute, reverse-engineer, or create derivative works without our written permission.

9. Termination & Suspension

We may suspend or terminate your account immediately and without prior notice if:

  • You breach any provision of these Terms
  • We suspect fraud, illegal activity, or high-risk behavior
  • You fail to pay any fees or charges
  • Required by law, payment partners, or regulatory authorities

You may terminate your account at any time by contacting support. Upon termination, all rights to use the Services cease immediately.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Zamider Pay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
  • Our total liability shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
  • We are not responsible for any loss due to merchant products/services, customer disputes, or third-party actions.

11. Indemnification

You agree to indemnify, defend, and hold harmless Zamider Pay, its officers, directors, employees, agents, and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Services
  • Violation of these Terms
  • Violation of any third-party rights
  • Your products/services or customer transactions

12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the People’s Republic of Bangladesh.
  • Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation.
  • Failing negotiation, disputes shall be resolved by arbitration in Dhaka under the Arbitration Act 2001, by a sole arbitrator appointed by mutual agreement.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email, dashboard notification, or by posting the revised Terms on the website. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
